Basically, we A2 long-distance pilots with our UAS up to 2kg (in the transitional regulation) have to keep a distance of 50 meters to bystanders. As soon as the long-awaited C classifications take effect, this can be reduced to 2 meters or 30 meters in slow flight mode for C5 drones. So that we don't have to wait so long for it, the Federal Ministry of Transport has given us commercial pilots a "treat":

The decree on commercial operation (...) in the open category, A2:

“A minimum horizontal distance of 30 meters must be maintained from uninvolved persons. If the UAS is operated in a separate slow flight mode and the operator ensures that a maximum speed of 3 m/s is not exceeded, the minimum horizontal separation is 5 meters.”

woo-hoo! Now we can carry out our commercial flights more easily with our Phantom 4 and the A2 license, for example, and maybe avoid the one or the other time without the time-consuming SORA/ConOps. However, this decree was only valid until August 31.08.2022, XNUMX.

Now the Federal Aviation Authority has followed suit as the supreme aviation authority:

The following regulation is stipulated in a general decree until August 31.08.2023, XNUMX:

  • Commercial use
  • Minimum distance to bystanders 30 meters (instead of 50 m)
  • Reduction of the distance to 5 meters when ensuring that the maximum speed of 3m/s is not exceeded
