What are the transitional rules, what must be observed from 01.01.2021/XNUMX/XNUMX?

Now the time has come: the EU regulation for handling UAS will come into force on January 01st, 2021. In addition to new drone driving licenses and various other changes, a one-year transition period (until December 31.12.2021, 21) has been set in which national evidence of knowledge according to §XNUMXa LuftVO remains valid. We would like to briefly summarize what this means and what must be observed here.

 

The operation of a UAS will in future be divided into three operating categories:

  • open, special and subject to approval.

The category "open" does not require approval, the following must be observed:

  • Flight altitude: up to 120 m above ground,
  • Visual contact with the drone during the entire flight,
  • Maximum take-off mass of the drone 25 kg,
  • no transport of dangerous goods,
  • no dropping of objects,

In addition, the category is openly divided into three sub-categories:

Sub-category A1:In this sub-category, UAS with a maximum

 

Takeoff weight less than 900 g used. UAS in sub-category A1 can fly at uninvolved persons. So avoid flying over people.

Sub-category A2:
In this sub-category, UAS is used with a maximum take-off weight of up to 4 kg. UASs operating in this sub-category can fly horizontally up to 30 m to interested persons. If the UAS is in slow flight mode, uninvolved people can be approached within 5 m.

Usubcategory A3:

In this sub-category, UAS with a maximum take-off mass of less than 25 kg are used. UAS in this subcategory may only fly if it can reasonably be assumed that no unaffected person is at risk during the entire flight. A minimum distance of 150 m from residential, commercial, industrial or recreational areas should be maintained during the flight.

Proof of knowledge (§21 LuftVO) entitles you to control drones in all sub-categories of the "Open Category"!
First of all, that's good news. But unfortunately it is accompanied by the restriction that the drone must be classified accordingly and this is so far at not the case with any drone.

So: Drones between 500g and 2kg may be flown in subcategories A1 and A3 (drones over 2kg only A3) with proof of knowledge. And we are only allowed to be human up to a distance of 50 meters approach.

What about waivers? Exemptions granted are also valid until December 31.12.2021, XNUMX (this applies to both general decrees and individual permits).

Since the proof of knowledge is a national document, the transitional regulation naturally only applies to Germany. In other words, to fly in other EU countries, the EU competence certificates are required.

Important! From 01.01.2021, every remote pilot must be registered. Online registration at the Federal Aviation Office is open until December 31.12.2020, XNUMX HERE to be possible.
You will receive a so-called e-ID, which must be attached to the drone and replaces the previous "identification plate".
